Keep. As someone with a bit of experience in this area, I think you misinterpretted the e-mail you received. It does correctly state that restrictions are not directly linked to the copyright status. An image can be copyrighted and restricted, or it can be be copyrighted and unrestricted. However, an unrestricted image is always still free to be used regardless of its copyright. For instance this image comes from a collection where the donor has retained ownership of the copyright, and plaed several conditions on republishing it. By contrast this image comes from a different collection with no usage restrictions. - SimonP 00:56, 28 June 2006 (UTC)[reply]

As the email I posted appear to be clear, "the Restrictions on use/reproduction: Nil" is NOT intended to apply to further use by third parties, why else would there be requests that, "In order for our Bureau to proceed with providing copyright permission for the requested material could you please supply the following information[...]" Circeus 01:05, 28 June 2006 (UTC)[reply]

The e-mail you cite states quite clearly that "the Restrictions on use/reproduction" section is one that deals with third party use. It mentions a hypothetical restriction that an image "could not be used/reproduced for commercial advertising purposes."
