Fair use rationale for Image:Rasmus-Peep.jpg

Image:Rasmus-Peep.jpg is being used on this article. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in this Wikipedia article constitutes fair use. In addition to the boilerplate fair use template, you must also write out on the image description page a specific explanation or rationale for why using this image in each article is consistent with fair use.

In 2001 there was a suit about breach of confidentiality related to the song: http://www.mtv.com/news/1442126/ray-parker-jr-suing-huey-lewis-over-ghostbusters-comment/ and in 2013 he sued over lost royalties: http://www.digitalspy.com/music/news/a520088/ray-parker-jr-suing-over-ghostbusters-royalties.html#~oRLgn7mS6BB1re shouldn't this stuff be included? RIAA certification entry

How do I update the RIAA database link for the song's certification figures? The link that's currently referenced doesn't work, as it comes back with no search results.
