The statue may be located on US land, and owned by the US, but the copyright for the statue is not. The work was funded by private citizens and created by a private citizen. - CriscoThis is confusing to me, because using your logic photos of the statue of liberty cannot be used because the statue was designed by someone outside the government. It is my understanding that there is no protection for any photo of any national monument. If you are correct and I am wrong, then I apologize. Akjayintx (talk) 013:34, 1 July 2015 (UTC)
- CriscoWhat must be done in order for photographs of the national monument to be considered public domain? Does the John Burnam Memorial Foundation have to do a letter stating as much? - You are confusing "national monument," which is normally a federal park property, with sculpture on federal property. Unless the sculptor has specifically released his composition into the public domain, the sculptor retains copyright on all representations of their work, including photographs taken by public employees in the course of their work. Since the work appears to have been done for a non-profit, rather than for the federal government directly, it seems unlikely that the sculptor has relinquished their rights to images of their work. Even if done for the government, the sculptor would probably have to stipulate that they have released their rights in their contract. Wikipedia is a free-content encyclopedia - if images are to be used, they must be used under the fair use doctrine. The presumption on all recent sculptural works is that images of them are subject to copyright restrictions. A fair use rationale is doable, but the procedure outlined in the link must be followed. - I wold suggest obtaining permission from the sculptor that stipulates that photographic representations may be licensed under a Wikipedia-compatible license. Please note that since Wikipedia content is freely-licensed, this would be a broad license that only requires attribution under CC-by-SA copyleft, so they may not be keen on that. Wikipedia-only or non-commercial-use licenses aren't suitable. A fair-use rationale might be the most feasible path. Acroterion (talk) 22:21, 9 June 2018 (UTC)
