"News Flash": I almost fell over when I saw this. We have have had proof all along sitting right here: Image:Marked-ap-letter.jpg. It is a letter from the Associated Press that is giving permission for two images to be used. But the very last paragraph should be extremely clear: "With respect to any and all other photographs in which The Associated Press is the copyright holder, The Associated Press reserves all its rights, and specifically does not agree that any Wikipedia publication of a copy-protected Associated Press photo in which a Wikipedia user chooses to upload would constitute fair use." We can assume good faith that the uploader did not know this, however the fact remains the image is a blatant copyvio and needs to go. Aside from the legal aspects please read "Dispatches: Reviewing non-free images" Non-free content criteria - Wikipedia-wide criteria - "Reviewers should consider the commercial activities of the image's copyright holder and the image's role in those activities. - Comment It seems to me that my understanding of WP:NFCC is far more flawed than I thought, so I'd appreciate it someone could explain why the critera fail.
I haven't looked very long, but so far I haven't found a free image that could replace it, although there exist certainly thousands of pictures that show the damage. A new one can't be taken anymore, so WP:NFCC#1 seems to apply. I would also think that it passes WP:NFCC#2 due to the lower resolution (there is e.g. [1]). Having a picture of the damage to the building is important for the understanding of the topic (WP:NFCC#8). It also seems to clearly pass all other criteria as well.

- It fails WP:NFCC2 because photo agencies charge several hundred dollars per year for the use of thumbnail-size images on webpages. You can check out sample licensing fees on Getty Images' website if you like. MSN is certainly paying license fees for this. It displaces the market role of the original image because we are using it for the exact use that AP intended to use it, the use for which it took the photo - charging people for the use of images, even small images. - Reply: I was going to reply on your talk page but figured this topic is spread out enough. :) Ok - so one of the easiest ways to answer is to read (re-read if you have read already) "Dispatches: Reviewing non-free images" Non-free content criteria - Wikipedia-wide criteria. It takes all the current criteria and breaks it down with valid and not valid examples. The "Example that fails" that would relate to this image is "An image of a current event authored by a press agency. Certain press agencies market photographs to media companies to facilitate illustration of relevant commentary. Hosting the image on Wikipedia would impair the market role (derivation of revenue), as publications (such as Wikipedia) would normally need to pay for the opportunity to utilize the image." In this case it has nothing to do with finding a free replaceable version, it has to do with the original source of this image - The Associated Press. First you have to ask "How was the image obtained?" and it does not appear that this image was obtained directly from the photographer of the agency the is representing the image. Forgetting about any "Fair Use" for a moment you have an image that was obtained on a website that had to pay to use the image. This is a blatant copvio. Now lets add the "fair use" part - if you took, for example, a screen shot of this MSNBC page and used it in an article about MSNBC it would be safe to use a FUR. Even better if the article was about MSNBC's coverage of the Australian Embassy attack. But this is not what is going on at all. Someone actually took one image from the article, as it appears on the MSNBC website, and has now used it as a "featured" image in an article not related at all to MSNBC. More important is that the actual article as well as the images are not owned by MSNBC, they are all sourced to The Associated Press. So this is a blatany copyvio. Fair use does not cover what happened in this case. But...
- Lets take MSNBC out of the picture. Now lets say the editor went direct to The Associated Press and obtained the image. If the editor simply takes an image of their website and uploads it here that is, again, a copyvio. The argument is that as long as a FUR is tagged onto the image it is no longer a copyvio. (or at least eligible in the world of wiki to be considered one) This is a false assumption because all photo agencies are based on the end user obtaining a License Agreement, this includes obtaining images for editorial use. The basis of fair use is editorial use and, in the cases of photo agencies that is impossible because their core business revolved around the sales of certain images for use in media. That fact is covered in Licensing policy of the Wikimedia Foundation, although in a general manner. The first thing on this resolution is the following: "The content of this page is an official policy approved by the Wikimedia Foundation Board of Trustees. This policy may not be circumvented, eroded, or ignored on local Wikimedia projects." In this policy "fair use" is the equal of the "Exemption Doctrine Policy (EDP)" and as such, aside from the actual U.S Copyright law, is the core set of "laws" that lay down the foundation (no pun intended) for all "non free" image use on Wikipedia. Number 3 says "Such EDPs must be minimal. Their use, with limited exception, should be to illustrate historically significant events, to include identifying protected works such as logos, or to complement (within narrow limits) articles about copyrighted contemporary works. An EDP may not allow material where we can reasonably expect someone to upload a freely licensed file for the same purpose, such as is the case for almost all portraits of living notable individuals. Any content used under an EDP must be replaced with a freely licensed work whenever one is available which will serve the same educational purpose."
- On Wikipedia that policy is the core of the Non-free content criteria policy which starts off with the statment "For the purposes of this policy "non-free content" means all copyrighted images, audio and video clips, and other media files that lack a free content license. There is no automatic entitlement to use non-free content in an article. Such material may be used on the English Wikipedia only where all 10 of the following criteria are met." Note the important wording that says "all 10 of the following criteria" must be met. The above image may indeed meet some of those 10 criteria but does it meet all of them? Now is the time to remind people of the actual source of this image - The Associated Press. And what is it they are? To use their own wording "AP delivers more than 1,000 photos a day from journalists recording news as it happens around the world. AP photos are an important part of modern-day world history - for more than a century, AP photographers have captured the greatest moments in history, news, sports and entertainment." With that in mind now look at the Non-free content criteria policy, criteria number 2 - "Respect for commercial opportunities. Non-free content is not used in a manner that is likely to replace the original market role of the original copyrighted media." There should be no doubt at this point that this image fails at least one of the criteria. And even if it met the other 9 the fact it failed one is enough to reject the FUR. The only way to legally use this image would be to obtain an OTRS on the image. It could be done - but now you have to meet The Associated Press's terms, not ours. Aside from the actual license details an editor can follow this: "All requests for republication of AP material must be in writing, clearly stating the purpose and manner in which the copy will be used. All republished material must carry AP credit. Unless specifically noted otherwise, all permission is given for one-time use only. No political candidate, political party, political action committee, polemical organization, or any group formed for partisan purpose may use AP copy in any publication. There may be a fee for reprint use."
- See this really is a larger issue because, lets say this was uploaded under a free license and still gave credit to A.P. An editor could have tagged it either an i9 or with a {{di-no permission}} but another editor could come along and "fix" the issue by slapping a FUR on it. But the core issues still remain. Is it a copyvio? Clearly yes it is as it was not obtained directly from The Associated Press. So it could be tagged with {{db-i9}}. Now if the source the image was obtained from was The Associated Press and it has one of those "I asked and they said it was ok" type of comments we can certainly assume good faith and tag it with {{di-no permission}} which would allow an OTRS ticket to be obtained. But what is happening is all of that is being overlooked because there is a FUR. So now the discussion becomes kind of silly because the implication is that the foundations core policy as well as Wikipedia's core image policy do not really matter because, "in good faith", someone slapped a FUR on it. Perhaps it was the uploader or perhaps it was just a passing editor who feels the image was mislabeled on upload. Now the suggestion becomes {{db-i7}} but that too could be removed by anyone because they feel the image that is newsworthy can have a FUR on it. And that puts the image into the same type of situation we are in now.
- Wow, this is long. Well - there is nor real short "black and white" way to explain this all. As far as meeting other criteria. This is just one example that is easy for me to use without much work. Say someone uploaded this image and put a FUR on it. This is an A.P photo of a rescue dog at the World Trade Center site. If this was used in an article about rescue dogs at the World Trade Center site it would seemingly meet the Non-free content criteria. But you don't have to search far to find several versions - September 22, 2001 and September 21, 2001 are just two. Now here is a little tricky reason why I mentioned this as well. The photographer of the free images also works for A.P and you will often see her images with an A.P credit. In some cases, but not all, photographers will be a part of a "pool" and their images will be sent out across all the wire services. Bit in regards to this specific image - Other than the flag it is not much different that this free image: An American flag is flying at half mast. Or without a flag - This building adjoining the World Trade Center sustained considerable damage during the terrorist attack. I know it is not the same, but the image in question is being used in an article about the "2004 Australian embassy bombing" but yet this image is not even used to show the embassy (Another reason why it fails Non-free content criteria) - it is being used to show "The Australian flag continues to fly in front of a neighboring building devastated by the bomb". That being the case you could use one of these free use images and say something such as "The bomb caused damage much like this to surrounding buildings" Now if you wanted to try another "fair use" approach maybe try one of these: ranwar's photostream or amang1984's photostream. The only thing that can outweigh NFCC#2 for press photos, in my view, is truly iconic pictures or those where the picture itself has become the subject of much sourced historical commentary. This image meets neither of these conditions. For a list of pictures that do (in my opinion) meet such conditions, please see the old (April 2008) debate at Wikipedia:NFCC Criterion 8 debate, and specifically the best practice section here, which includes some AP pictures. I had intended to turn that section (and others from that debate) into a proper guide, but never found the time. Possibly next month. In passing, it is worth noting that I've always held the position that our EDP (the NFCC criteria) may be more restrictive than that required by the Foundation's Licensing Policy, which says "Such EDPs must be minimal. Their use, with limited exception, should be to illustrate historically significant events..."
